Acknowledgment, Disclaimer And Waiver Of Liability

Important Notice

San Miguel Outdoors, Inc. requires that each person(s) or entity who books activities of any kind through San Miguel Outdoors, Inc. is required to read and sign this Disclaimer of Liability. Failure to sign this Disclaimer of Liability may result in the cancellation of your booking and forfeiture of any and all deposits or payments.

Disclaimer of Liability

San Miguel Outdoors, Inc. and its employees, referred to herein as Booking Agent, acts solely as a booking agent for providers of transportation, hotels, camps, hunting, fishing and game lodges, guides and outfitters and others, referred to herein as Providers who provide services, activities and accommodations as part of their respective business activities. Client is referred to herein as any person(s) or entity booking any such services through Booking Agent. Therefore, Booking Agent assumes no liability and Client by acceptance of the services provided agrees that Booking Agent shall not be liable or responsible for any loss, expense, damage (whether financial or otherwise), accident, delay, inconvenience, injury or death which results directly or indirectly from any act or failure to act whether negligent or otherwise by Providers. Further, Booking Agent makes no guarantees as to the success, quality or fitness of the services of the Provider to Client as many factors such as weather, game habits, changing game and wildlife migrations, Client’s skills and many other factors are beyond the control of Booking Agent. Client acknowledges that any activity may involve inherent dangers and may require extreme physical activity. The Client shall be responsible for any and all costs of accommodations and transportation for overnights in route resulting from weather conditions, overbooking by transportation providers or any other event beyond the control of Booking Agent. Booking Agent reserves the right to decline to accept or retain any person as a participant in any activity booked and to cancel any activity or trip prior to departure in which case a full refund will constitute full settlement to Client. All quoted prices, rates and fees are subject to change without notice and Client agrees to be responsible for any such changes in costs. Baggage, equipment and all other personal property are the sole responsibility of the Client at all times. Booking Agent shall not be responsible for the return of any deposits or payments to Client due to the cancellation or change of schedule by Client or Providers to Client. Any refunds, credits or exchanges for services are the sole responsibility of Providers. Client acknowledges that insurance was available that would provide Client compensation for lost or damaged luggage, trip cancellation, medical expenses and provider bankruptcy. This Disclaimer of Liability shall be construed and enforced in accordance with the laws of the state of Texas. Any action brought by either party pursuant to this Disclaimer of Liability, whether an action in tort or in contract shall be brought in Travis County, Texas and both parties consent to venue and jurisdiction in such. By signing this Disclaimer of Liability and making payments or deposits to Booking Agent, Client agrees to be bound by all the above stated terms and conditions.

Other Notice

San Miguel Outdoors Inc. hereby reserves the right to unconditional use and reproduction without cost of all photographs taken during any outdoor activity booked through San Miguel Outdoors, Inc.

Cancellation Policy

If you cancel or are unable to attend your trip, you may request that we re-sell your trip for you. If we are successful in reselling your trip, you will be assessed a fee of 20% of the price of the trip. If you find someone to take your place, no fee will be charged. However, if the trip is not sold sixty (60) days prior to your departure date, all payments and deposits will be forfeited.

If your trip provider cancels your trip for any reason we will diligently work in your behalf to try to rebook your trip with your outfitter. If we are successful in rebooking your trip, no fee is due.

All notices of cancellations, re-booking or resale requests must be either faxed or mailed to us. Other than the terms stated in this “Cancellation Policy”, any and all payments made by you are not subject to refund under any circumstances.

Many experienced hunters and travelers rely on Trip Cancellation Insurance to compensate them for unforeseen events that can alter their travel plans. Information and forms for Trip Cancellation Insurance are available to you through our office. You may either link directly to the Trip Cancellation Insurance provider through our website or request us to mail the forms to you.

Administration Fee (per person):

  • $35 – North America Trips (including the San Miguel Ranch & Lodge)
  • $85 – International Trips (all destinations outside of North America)
  • This fee is not refundable if the booking is cancelled.
